Supplemental Proof of Claim for CARES Forbearance Claim

The Consolidated Appropriations Act of 2021, allows an “eligible creditor” to file a supplemental proof of claim for a CARES Act forbearance in a chapter 13 case. A new form of Supplemental Proof of Claim for CARES Forbearance Claim, national bankruptcy form 4100S, has been created for this purpose. In addition, a new CM/ECF event has been created entitled “Supplemental Proof of Claim for CARES Forbearance Claim” and is available in the Claims Action category.  For more information on the substantive legal changes, see Section 1001(d) of Title X of the Consolidated Appropriations Act (Pub. L. 116-260) which creates a new section 501(f) of the Bankruptcy Code.
